The SEC and CFTC have agreed to coordinate crypto oversight across policymaking, examinations, enforcement and data sharing.

The memorandum of understanding, announced March 11, created the Joint Harmonization Initiative. The initiative will work on aligned regulatory definitions, joint interpretations and rulemakings, and a framework for crypto assets and other emerging technologies.

Robert Teply of the SEC and Meghan Tente of the CFTC will co-lead the initiative. SEC Chairman Paul S. Atkins called the agreement “a roadmap for a new era of harmonization between the agencies,” while CFTC Chairman Michael S. Selig said it “solidifies the agencies’ commitment to harmonize regulatory frameworks.”

A related joint rulemaking took effect March 23. The SEC issued an interpretation covering certain crypto assets and transactions, and the CFTC issued related guidance.

The agreement is intended to reduce duplicative requirements and provide clearer rules for market participants. The final rule preserves the agencies’ separate statutory authorities, and the framework does not alter those powers.
