The U.S. Clarity Act has failed after months of negotiations, leaving federal oversight of digital assets and key market rules unresolved.

The legislation was intended to define the treatment of digital assets at the federal level. Its collapse leaves the SEC and CFTC without a new statutory framework for resolving which agency should oversee parts of the market.

Lawmakers also remained divided over how to classify NFTs, decentralized finance protocols and stablecoins. Those disagreements prevented a final compromise and kept the measure from reaching a final vote.

The setback extends legal uncertainty for traditional financial institutions and crypto companies operating in the United States. It also delays efforts to establish common compliance standards across the industry.

The failed negotiations leave existing regulatory disputes in place.
