> The verdict covers haptic technology used in Apple Watch and iPhone devices, but the award may change after post-trial motions and an appeal.

A federal jury in San Diego has ordered Apple to pay more than $5.7 billion after finding that haptic technology in its iPhone and Apple Watch devices infringed Taction Technology patents.

The verdict, returned Friday, Sept. 25, covers two vibration-based patents that let users feel a device’s response to an input. Taction sued Apple in 2021, alleging that the company used its inventions without authorization in its haptic engines.

Apple rejected the finding and the damages award, saying its haptic technology is fundamentally different from Taction’s and that product testing during the trial supported its position. The company plans to appeal.

The case was dismissed in 2023 before the U.S. Court of Appeals for the Federal Circuit revived it. Apple introduced its haptic engine with the Apple Watch in 2014 and brought the technology to the iPhone 6s and iPhone 6s Plus the following year.

The award is not yet final. The trial judge must first rule on post-trial motions before the case proceeds through the appeals process.
