# CFTC Sends Two Competing Event-Contract Rules to OIRA for Review

The Commodity Futures Trading Commission has submitted two competing event-contract rulemakings to the White House Office of Information and Regulatory Affairs, setting up a regulatory split that could shape U.S. prediction markets and derivatives platforms.

One submission would further define “swap” to exclude casino-style gambling products. OIRA lists it as an interim final rule. The second would further define “swap” to include event contracts and is listed as a proposed rule.

Both submissions entered OIRA review on Sept. 28, and neither has a legal deadline listed. The competing approaches would give the CFTC different paths for determining how event contracts are treated under the Commodity Exchange Act.

The review concerns the legal boundary between event-based products treated as swaps and products outside that definition, an issue with direct implications for platforms offering prediction-market contracts in the United States.
