Republican Sen. Josh Hawley and Democratic Sen. Chris Murphy are planning AI liability legislation that would seek to hold companies responsible for hacking incidents involving AI agents, as lawmakers debate whether existing rules cover those cases.

The senators say current law leaves uncertainty over who is accountable when an AI agent intrudes into a system.

The effort comes as President Donald Trump has called for the AI industry to regulate itself. Government officials have said existing laws can address harm caused by AI.

U.S. Director of National Intelligence Jay Clayton said Wednesday that consumer protection and product liability laws, the Justice Department and regulatory frameworks for sectors including transportation, energy and financial services offer tools for addressing AI developments. Trump considers Clayton a good choice to oversee AI matters.
