# Judge Dismisses Chegg and Penske Antitrust Cases Over Google AI Overviews

A federal judge dismissed antitrust lawsuits by Chegg and Penske Media Corp. over Google’s use of publisher content in AI Overviews, finding the companies had not plausibly established reciprocal dealing or antitrust standing.

U.S. District Judge Amit Mehta ruled Sept. 30. The complaints alleged that publishers faced a choice between allowing Google to use their content in AI-generated search summaries and risking lower visibility in search results, while the summaries could reduce visits to publisher websites.

Mehta wrote that publishers’ expectation of receiving search traffic in exchange for making content freely available did not amount to an agreement. He also said he was “not unsympathetic” to publishers’ position, while noting that antitrust law was not a substitute for lawmakers addressing disruption caused by new technology.

Chegg, an education technology company, filed its lawsuit in February 2025. Penske Media, which publishes Rolling Stone, Billboard and Variety, filed its case in September 2025. The cases were heard together in August 2026.
