# House Panel Advances Digital Asset Tax Certainty Act in 38-5 Vote

The House Ways and Means Committee advanced legislation addressing digital-asset taxes and reporting in a 38-5 vote, moving the measure forward without passage by the full House or action by the Senate.

The committee ordered the Digital Asset Tax Certainty Act, H.R. 10357, favorably reported, as amended, on Sept. 16, 2026. The bill addresses tax rules and reporting for digital assets, including mining and staking.

The committee action is separate from Sen. Cynthia Lummis’ Senate proposal, S. 2207. That bill would create a $300 per-transaction tax exclusion for certain digital-asset transactions, with a $5,000 annual cap.

The Joint Committee on Taxation estimated that S. 2207 would generate about $600 million in net revenue over the 2025-2034 budget window. The committee vote advanced H.R. 10357 from committee; it did not pass the full House or establish Senate support.
