# SEC Approves Cboe Rule for Six 3x Leveraged Funds

The U.S. Securities and Exchange Commission approved a Cboe BZX Exchange rule change Oct. 2 covering six leveraged funds, including products tied to Bitcoin (BTC) and Ether (ETH) futures. The order does not confirm effective registration or that trading has begun.

The VS Trust funds target three times the daily performance of specified Bitcoin and Ether futures benchmarks before fees and expenses. The benchmarks are based on first- and second-month futures contracts, with cash and cash equivalents serving as collateral or margin.

The daily objective does not determine longer-term returns. Gains and losses compound as the funds rebalance, so performance over longer periods can differ from the daily target.

The SEC classifies the products as Commodity-Based Trust Shares. Although their names include “ETF,” the funds are not regulated as investment companies under the Investment Company Act of 1940.

The approved rule also covers four funds tied to gold, silver, crude oil and natural gas. No first trading date is confirmed.
