Roman Storm said federal prosecutors in New York continue to argue that lawful transactions through Tornado Cash are criminal, a position he says puts open-source software developers at risk.

Storm, a Tornado Cash co-founder and developer, said the case has lasted 1,139 days. He also said the U.S. Treasury Department acknowledged that a proposed rule for cryptocurrency mixers could chill lawful activity before withdrawing it.

Storm said prosecutors recently filed a legal document in New York and argued that their position conflicts with the Treasury Department’s action.
