The Justice Department (DOJ) is reviewing whether Binance violated the terms of its 2023 plea agreement, raising the possibility of renewed criminal action against the cryptocurrency exchange.

The review is tied to an investigation into whether Binance knowingly allowed transactions that violated U.S. sanctions on Iran. In September, prosecutors sought to seize about $61 million in cryptocurrency that investigators said came from illegal Iranian oil sales and moved through Binance accounts.

Tyson Duva, head of the DOJ’s Criminal Division, confirmed the department’s involvement but did not say Binance had breached the settlement. No new charges have been filed against Binance or its employees.

Binance and founder Changpeng Zhao pleaded guilty in November 2023. The exchange agreed to pay about $4.3 billion under the settlement, which included a three-year DOJ monitorship by Forensic Risk Alliance and five years of oversight from the Financial Crimes Enforcement Network.

A finding that Binance breached the agreement could reopen criminal prosecution over conduct covered by the settlement and expose the exchange to additional multibillion-dollar penalties.
