> The Delhi High Court declined to let the company make more products under the label, although an earlier order allowed it to sell existing labeled stock.

PepsiCo told the Delhi High Court on Oct. 15 that limits on using the “energy drink” label could leave its energy drinks out of stock across India within two months.

The court declined to let PepsiCo resume manufacturing under the “energy drink” label. The dispute concerns India’s food-labeling rules, overseen by the Food Safety and Standards Authority of India (FSSAI).

An Oct. 6 court order allowed PepsiCo to sell inventory already carrying the label, but it did not authorize additional production using that description. The orders distinguish sales of existing units from manufacturing more products under the contested label.

PepsiCo warned that continued limits could deplete its stocks of energy drinks across India within two months. The company framed this as a potential shortage if the restriction continues, not as a report that stocks have already run out.

Rival Red Bull GmbH remains able to sell its drinks in India while PepsiCo faces the manufacturing limit.
