> His petition challenges limits on evidence about customer losses and the forfeiture under the Eighth Amendment; the government must respond by Nov. 16.

Former FTX CEO Sam Bankman-Fried is asking the U.S. Supreme Court to review his fraud conviction and $11 billion forfeiture, arguing that jurors should have heard more evidence about customer losses and that the forfeiture violates the Constitution.

A jury convicted Bankman-Fried on seven fraud counts in 2023, and he received a 25-year prison sentence. His petition challenges the court’s refusal to let the defense present evidence about whether customers suffered losses. Many FTX users began receiving repayments in 2025.

The Second Circuit ruled in June 2026 that customers were defrauded when their funds were transferred to Alameda Research, regardless of whether Bankman-Fried believed he could repay them.

His petition also argues that the forfeiture violates the Eighth Amendment’s ban on excessive fines. The government’s response is due Nov. 16, after the Supreme Court extended the deadline. The court has not said whether it will hear the case.
