> The proposal would require platforms to check DeFi protocols before offering access and monitor them afterward for vulnerabilities and suspicious activity.

France proposed making regulated crypto platforms responsible for certain incidents affecting customers who access decentralized finance (DeFi) protocols through them, as the European Union reviews its crypto rules.

The French Treasury, the Autorité des Marchés Financiers (AMF), Banque de France and the Autorité de Contrôle Prudentiel et de Résolution (ACPR) submitted the proposal as part of the review of the Markets in Crypto-Assets Regulation (MiCA).

Under the plan, crypto-asset service providers would check protocols before offering customers access and continue monitoring for vulnerabilities and suspicious activity. The authorities also support certification for DeFi protocols and smart contracts. Significant providers would face the full requirements, with obligations scaled for smaller firms.

A platform could still connect customers to an uncertified protocol if it conducted its own checks and provided stronger risk disclosures. The authorities opposed a blanket certification requirement for developers of self-custody wallets, while supporting voluntary certification for advanced wallets that integrate DeFi services.

France also proposed giving the European Securities and Markets Authority (ESMA) oversight of significant crypto-asset service providers across the EU. The recommendations are part of a review and have not changed MiCA’s rules.

The European Commission must report to EU lawmakers on MiCA’s application by June 30, 2027, with a legislative proposal if warranted.
