> The ruling party leader wants a year-end decision on whether to keep the planned 2027 tax start or strengthen the system first.

South Korea’s proposed Digital Asset Basic Act has entered final negotiations as ruling party leader 金民錫 called for a year-end decision on the country’s planned crypto-income tax.

Financial Services Commission Chairman Lee Eog-weon told lawmakers Oct. 22 that officials would move the bill toward legislative discussion as quickly as possible. A government draft could be completed as early as the end of October, then introduced as a lawmaker-sponsored bill after talks between the government and the ruling party.

Key unresolved provisions include a 15% to 20% ownership cap for major shareholders in crypto exchanges and an initial path for won-denominated stablecoins. Under that approach, issuance would begin with consortia in which banks hold a majority stake.

South Korea’s tax is scheduled to start Jan. 1, 2027, following three delays. It would apply a combined 22% other income tax and local income tax to annual income from digital asset transfers and lending above a 2.5 million won deduction. Four bills before the National Assembly seek to repeal or postpone the tax. 金民錫 wants a decision by year-end on whether to proceed on schedule or strengthen the system before implementation.

One Democratic Party proposal would set the start date at Jan. 1, two years after the first year of information exchanges under the Organization for Economic Cooperation and Development’s Crypto-Asset Reporting Framework (CARF). Those exchanges are scheduled to begin in 2027, while U.S. participation is due in 2029. The proposal argues that overseas trading records may be difficult to obtain before then, potentially leaving domestic exchange users carrying more of the tax burden.

The government’s draft is expected as early as the end of October, with legislative progress to follow party-government talks.
