Pennsylvania Gov. Josh Shapiro signed a law requiring disclosures on AI-generated or significantly modified ads that create a false consumer perception about advertised goods or services, adding a new state safeguard against deceptive marketing.

The law bars advertisers from knowingly, recklessly or willfully creating or disseminating covered ads without disclosure. The notice must appear the first time the content is presented and use the same medium. When technically feasible, it must be permanent or extraordinarily difficult to remove.

The law applies when the content creates a false consumer perception about the nature, origin or authenticity of the advertised goods or services. It exempts content limited to text, evidently fictional depictions, and material involving parody, satire, commentary or criticism.

State Sen. Nick Pisciottano, the bill’s sponsor, called the measure “a major step for consumer protection in Pennsylvania.” The Senate passed the bill 48-2 on June 10, and the House approved it 163-40 on Oct. 7.

The state attorney general or an appropriate district attorney may seek an injunction or bring a civil case. A court may award a civil fine of up to $3,000, plus actual attorney fees and court costs. The law takes effect 60 days after enactment.
