MZX Tech LLC is offering to buy homes near its Southaven power plant on condition that sellers give up claims tied to a lawsuit alleging noise and vibrations at the facility.

The company’s letter to residents says homeowners who accept an offer would sign a separate release at closing. The release covers potential claims related to the Southaven Plant, including the federal lawsuit brought by Jason Haley, Preston Herrington and Taylor Logsdon. Under its terms, sellers would give up the right to seek damages in that case or bring related claims individually. The letter does not state an offer price.

The three residents filed a complaint June 8, 2026, against MZX Tech, X.AI Corp. and Space Exploration Technologies Corp. It alleges that noise and vibrations from gas-fired turbines interfere with residents’ use of their property and seeks to represent other residents in a proposed class action.

“MZX denies all of the allegations against it,” the company’s letter says.

Southaven Mayor Darren Musselwhite said Oct. 1 that “the noise has been a legitimate concern.” He also said the facility had not violated the city’s noise ordinance, and that the home-buying plan would accompany noise mitigation efforts and could provide housing for specialized workers moving to the area.
