> The bill passed the House in 2025 but fell short in a September Senate vote. If it does not pass before Jan. 3, it would need to be reintroduced.

Democrats’ [Senate win](<https://www.tokenpost.com/news/regulation/49091>) has put Sen. Elizabeth Warren in line to lead the Banking Committee, where the CLARITY Act could face a new committee review if it does not pass before Jan. 3.

Warren is the committee’s top Democrat. The Democratic caucus has not formally assigned leadership posts, so her chairmanship is not settled. The current Congress remains under Republican control until the new Congress convenes.

Sen. Sherrod Brown, who chaired the Banking Committee from 2021 to 2025, is returning to the Senate after winning Ohio’s election Tuesday, Nov. 3. His 2024 Senate loss interrupted his service, leaving him behind Warren in seniority under Democratic caucus rules.

The crypto market structure bill passed the House 294-134 in July 2025. On Sept. 15, the Senate rejected a motion to advance it 49-50, short of the 60 votes needed. No Democrat voted in favor. Warren has been one of the bill’s leading opponents.

If the measure does not pass before the new Congress convenes Jan. 3, it would have to be introduced again and undergo committee review. Warren’s potential leadership could put her at the center of that process, but the caucus has yet to make its decision.
