> Earlier this year, the daily demands were about $1 million. Only 50% to 60% of U.S. capacity scheduled for the next one to two years is expected to open on time.

AI data center tenants are seeking more than $5 million a day in penalties when developers miss deadlines to deliver power or facilities. The daily demands were about $1 million earlier this year, a sharp increase in the amounts tenants are seeking over late delivery.

For U.S. projects scheduled to come online over the next one to two years, the outlook puts on-time capacity at 50% to 60%. Power availability, permitting, equipment shortages and construction delays are among the constraints affecting projects.

The higher penalty demands suggest tenants may be seeking to shift more schedule risk to developers. The figures describe demands; they do not establish that contracts have adopted those terms.

Power infrastructure delays could slow facility openings as demand rises, a risk discussed in [earlier coverage of power delays at AI data centers](<https://www.tokenpost.com/news/technology/35729>).
