Ripple CTO Emeritus David Schwartz has weighed in on the growing legal battle involving Elon Musk’s X, formerly Twitter, after a federal court ruled that the platform’s recommendation algorithms are protected under Section 230 of the Communications Decency Act. The decision has sparked fresh debate around free speech, social media liability, and algorithmic amplification in 2026.

The lawsuit, Taddeo-Waite vs. X Corp., accused X of failing to remove harmful content while allegedly boosting certain posts through its recommendation system. The plaintiff also claimed the platform suppressed her own content despite being a paid subscriber. However, Magistrate Judge Ray ruled that Section 230 shields X from liability tied to user-generated content and its distribution across the platform.

Reacting to the ruling, David Schwartz argued that holding platforms liable for recommending or amplifying speech creates a dangerous legal precedent. According to the Ripple executive, “the theory that amplifying or recommending speech makes you liable for its contents is a brand new theory of liability for speech,” adding that such liability conflicts with First Amendment protections.

The court further stated that X’s recommendation algorithms did not materially alter the original content posted by users. Judges compared algorithmic recommendations to traditional editorial decisions made by publishers when deciding which stories receive greater visibility.

The lawsuit also alleged breach of contract after X reportedly limited the plaintiff’s visibility despite her paid membership. Still, the court determined that Section 230 protections remained applicable.

The ruling, filed in April 2026 in the U.S. District Court for the Northern District of Texas, now awaits final review from Judge Reed O’Connor. The outcome is being closely watched as a major precedent for social media platforms, free speech protections, and algorithm-related lawsuits involving tech companies like X and other digital platforms.
