The urgency to advance the CLARITY Act markup is intensifying as political dynamics in Washington continue to shift, raising uncertainty around the future of crypto regulation in the United States. With control of the U.S. Senate hanging in the balance, lawmakers and industry experts are increasingly concerned that delays could jeopardize progress on the bill.

Alex Thorn, Head of Firmwide Research at Galaxy Digital, emphasized the importance of timing, noting that the tight Senate race could directly influence the fate of the legislation. He highlighted that scheduling the CLARITY Act markup soon is critical, as leadership of the Senate Banking Committee may change depending on election outcomes. If Democrats regain control, figures like Sherrod Brown or Elizabeth Warren could take charge, both of whom are viewed as less supportive of crypto-friendly policies.

Market sentiment reflects this uncertainty. Prediction platform Polymarket currently shows near-even odds between Republicans and Democrats for Senate control. Analysts warn that if leadership shifts toward more crypto-skeptical lawmakers, the CLARITY Act could lose priority or face significant hurdles.

Despite political risks, optimism around the bill has recently improved. Approval odds surged to nearly 69% before stabilizing between 63% and 65%, signaling renewed confidence among traders and observers. This momentum follows progress in resolving key disagreements, particularly around stablecoin yield provisions, which had previously stalled negotiations.

Senate Banking Committee Chairman Tim Scott indicated that the legislation has entered a decisive phase, often referred to as the “red zone,” with markup expected before May 2026. The CLARITY Act has already passed the House with bipartisan support, but Senate approval remains more complex due to regulatory differences.

Scott is prioritizing unified Republican backing before engaging further with Democrats, aiming to secure a clearer path forward. As the political landscape evolves, the coming weeks could prove critical in determining whether the CLARITY Act becomes a cornerstone of U.S. crypto regulation or faces further delays.
