The delayed Senate vote on the CLARITY Act has raised questions about whether the major crypto market structure bill can pass in 2026. However, Grayscale believes the setback is unlikely to have a significant near-term impact on Bitcoin, blockchain activity or stablecoin adoption.
Grayscale said the digital asset industry has operated for about 17 years without the CLARITY Act and can continue functioning without its immediate passage. The asset manager pointed to regulatory developments from federal agencies that have already provided greater direction in areas including institutional crypto custody, banking access, staking and crypto exchange-traded products.
Grayscale Research Managing Director Zach Pandl said lawmakers could still reach an agreement on the legislation. However, the limited Senate calendar and approaching 2026 midterm elections could make passage this year increasingly difficult.
The Senate is expected to revisit the CLARITY Act after its August recess. Senate Majority Leader John Thune has filed a cloture motion on the motion to proceed, with a cloture vote expected on September 15. Republicans control 53 Senate seats, meaning they would need Democratic support to reach the 60 votes required to advance the bill.
The CLARITY Act is designed to establish a federal regulatory framework for digital asset markets while defining the respective roles of the Securities and Exchange Commission (SEC) and Commodity Futures Trading Commission (CFTC). It would also establish rules covering crypto exchanges, intermediaries and tokenized assets.
Despite the legislative uncertainty, Grayscale expects activity on major blockchain networks and demand for Bitcoin to continue. Stablecoin payments could also expand as regulators address portions of the crypto market through existing authority and rulemaking.
Still, Pandl warned that failing to establish comprehensive US crypto regulations could discourage investment and capital formation. Digital asset companies may also shift operations to jurisdictions offering clearer regulatory frameworks.
Lawmakers remain divided over issues including stablecoin yield provisions and ethics requirements. Negotiations involving Congress and the White House are expected to continue ahead of the Senate’s return in September, keeping the CLARITY Act at the center of US crypto regulation debates.
