Caroline Pham Says SEC, CFTC Have Authority to Clarify Crypto Rules
Pham said reviewing existing agency mandates could identify the legal basis for clearer digital-asset regulations as Congress considers a larger role for the CFTC.

Caroline Pham said the Securities and Exchange Commission (SEC) and Commodity Futures Trading Commission (CFTC) already have the authority to establish clearer rules for digital assets, offering a regulatory path as Congress debates the CFTC’s role.
At Korea Blockchain Week, Pham said reviewing the agencies’ existing mandates could identify the legal basis for digital-asset regulation.
The comments come as leadership vacancies at both agencies remain part of the broader U.S. crypto policy debate. The CFTC has been led by Chair Michael Selig as its sole commissioner since Pham left in December 2025.
Congress is considering legislation that would give the CFTC a larger role in digital-asset oversight. The Digital Asset Clarity Act failed in the Senate.
