CFTC Moves Ahead With Crypto Exchange Rules Without Clarity Act
The agency plans two proposed regulations while most spot exchanges remain under state oversight without new congressional authority.

The Commodity Futures Trading Commission will move ahead with a federal regulatory path for crypto exchanges without waiting for Congress to pass the Clarity Act, reshaping the balance between federal and state oversight in the U.S. market.
CFTC Chairman Mike Selig announced the agency’s plan after the Senate failed to advance the legislation, which was intended to create a comprehensive federal framework for digital assets.
The approach includes two proposed regulations. Regulation CTX would address retail crypto transactions, while Regulation CAM would apply to federally registered crypto-market venues. The proposed framework would be optional for market participants.
Most current spot exchanges would remain under state jurisdiction because the CFTC lacks broader authority without congressional action. The agency’s proposals now put federal oversight on a separate track from the stalled legislation.
