The New York Times brought a copyright suit against Brave Software on Nov. 2, alleging the browser maker shared its journalism with users and AI firms, extending the newspaper’s litigation over AI use of its work.

The complaint brings claims under copyright law and the Digital Millennium Copyright Act (DMCA). It identifies Anthropic, Perplexity, Mistral, xAI and Cohere as companies Brave allegedly provided with Times content.

“While we believe in the ethical and responsible use and development of AI, Brave has flouted established copyright law and ignored repeated requests by The Times to stop its infringing conduct,” Times spokesperson Graham James said.

Perplexity Chief Communications Officer Jesse Dwyer responded: “The New York Times is overpaying its attorneys and underpaying its journalists. (Who could’ve easily identified the disinformation in this suit.)”

The Times brought a separate case against Microsoft and OpenAI in December 2023 over its journalism and other content. That litigation is part of consolidated federal proceedings in the Southern District of New York.
