More than 57 million early ballots had been cast across 47 states and Washington, D.C., by Monday, Nov. 2, a participation count that offers no indication of which party will control the Senate.

The Digital Asset Market Clarity Act of 2025 (H.R. 3633) is part of the election’s crypto-policy backdrop; the House passed it 294-134 on July 17, 2025. The bill would set federal rules for digital commodities and define the SEC’s and CFTC’s roles.

On Sept. 15, senators fell short of the three-fifths support needed to bring H.R. 3633 up for consideration, voting 49-50, with one senator not voting. That procedural tally was not a decision on final passage; the bill’s Senate path remains unresolved.

The election does not enact the bill, and the early-vote total records participation rather than candidate choices; Election Day is Tuesday, Nov. 3.
