Bitget Wallet research lead Lacie Zhang expects Democrats’ control of both chambers to delay U.S. crypto market structure legislation, while leaving near-term trading and product access largely unchanged.

The CLARITY Act passed the House in 2025, but a Senate procedural vote to advance it failed 49-50 on Sept. 15, 2026. The motion concerned advancing the bill; it was not a final vote on passage. TokenPost previously examined how a possible Democratic sweep could affect crypto legislation.

Zhang views passage of the bill in its present form as unlikely before the current session ends or after Democrats assume control in January. Future market structure legislation may require compromises on investor protections and ethics provisions. Legislation could be delayed or rewritten to place greater emphasis on consumer safeguards.

Zhang expects oversight hearings and late-session legislative efforts to bring possible volatility. She also expects the election’s near-term effect on everyday crypto investors to remain limited. Separately, work on custody, trading platforms and token classification is expected to continue under existing agencies.

The GENIUS Act’s federal rules for stablecoin issuance, reserves and redemptions are due to begin Jan. 18, 2027; the congressional change does not affect that scheduled start.
