Kalshi has asked the full Sixth Circuit to rehear a three-judge panel’s rulings in its disputes with Ohio and Tennessee over sports event contracts.

The Oct. 13 request challenges the panel’s decisions on preliminary injunctions in both cases. In late September, the panel declined to block Ohio gambling regulators from enforcing state law against Kalshi and vacated an earlier injunction involving Tennessee officials.

Kalshi argued that the panel misread the Commodity Exchange Act on two questions: whether federal law preempts state gambling laws and whether sports event contracts qualify as swaps.

Kalshi said it is still waiting to apply to the U.S. Supreme Court.
