NFL Files Supreme Court Brief Opposing Federal Prediction-Market Oversight

The league joins opposition to federal regulation of markets including Kalshi and Polymarket as the case moves toward a possible final ruling.

The National Football League has filed a brief with the U.S. Supreme Court opposing federal oversight of prediction markets, adding a major sports-industry voice to a dispute involving Kalshi and Polymarket.

The NFL’s filing argues against federal regulation of the markets as the case moves toward a possible final ruling. The Supreme Court dispute centers on which federal authority should oversee prediction-market activity.

Gary Gensler, a former regulator, and former Sen. Chris Dodd also filed briefs with the court this week. Dodd previously advanced legislation that the Commodity Futures Trading Commission uses to support its claim of final regulatory authority over prediction markets.

The filings arrive as the Supreme Court fight over the federal role in prediction markets nears a potentially decisive stage.
